Welcome to disabledvetscardonation.org (the “Website”), operated by DVEN (Disabled Veterans Empowerment Network), a 501(c)(3) nonprofit organization (EIN 99-5053861). These Terms and Conditions (“Terms”) govern your use of our Website and any donations or contributions made through it. By accessing or using the Website, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, please refrain from using our Website.
1. ELIGIBILITY
By using this Website or making a vehicle donation, you represent and warrant that:
– You are at least 18 years of age;
– You are the legal registered owner of any vehicle you donate, or you are legally authorized to donate the vehicle on behalf of the registered owner;
– The vehicle you are donating is free of any liens, loans, or legal encumbrances that would prevent a valid title transfer, unless otherwise disclosed to and accepted by DVEN in advance; and
– All information you provide to us is accurate, complete, and current.
2. WEBSITE USAGE
License: We grant you a limited, non-exclusive, and non-transferable license to access and use the Website for personal and non-commercial purposes.
Prohibited Conduct: You agree not to use the Website for any unlawful or unauthorized purpose, nor to engage in any activity that could harm, disable, overburden, or impair the Website or interfere with any other party’s use of the Website. This includes but is not limited to:
– Attempting to gain unauthorized access to any part of the Website or its related systems
– Introducing viruses, malware, or other harmful code
– Scraping, harvesting, or collecting user data without our express consent
– Impersonating any person or entity or misrepresenting your affiliation with any person or entity
3. VEHICLE DONATION TERMS
3.1 Donation Process
By submitting a vehicle donation request through our Website, by phone, or by any other means, you agree to donate the described vehicle to DVEN free of charge. Donations are irrevocable once the vehicle has been picked up and title has been transferred.
3.2 Vehicle Condition and Acceptance
Vehicles are accepted on an “as-is” basis. DVEN reserves the right, at its sole discretion, to decline or cancel acceptance of any vehicle donation for any reason, including but not limited to title issues, liens, or legal complications. DVEN makes no representation or warranty regarding how a donated vehicle will be used, disposed of, or sold.
3.3 Title Transfer
You are responsible for providing a properly signed and valid certificate of title at the time of vehicle pickup. Failure to provide a clear and transferable title may result in cancellation of the donation and return of the vehicle to you at your expense. DVEN is not responsible for any fees, fines, or legal issues that arise from your failure to properly transfer title.
3.4 Donor Responsibilities After Pickup
After your vehicle is picked up, you are responsible for:
– Notifying your state’s Department of Motor Vehicles (DMV) of the transfer or sale of the vehicle
– Canceling or transferring your vehicle registration as required by your state
– Canceling any auto insurance coverage on the donated vehicle
– Removing all personal property from the vehicle prior to pickup
DVEN is not responsible for any parking tickets, tolls, fines, or other charges incurred on the vehicle after the scheduled pickup date.
3.5 Pickup and Scheduling
We offer free vehicle towing and pickup. After you submit a donation request, our team will contact you to coordinate pickup scheduling. While we strive to offer next-day or prompt pickup, specific timing is subject to availability and will be confirmed with you directly. We are not liable for delays caused by circumstances outside our reasonable control.
3.6 Use of Donated Vehicles
DVEN may sell, auction, recycle, or otherwise dispose of donated vehicles in any lawful manner it deems appropriate to support its charitable mission. Proceeds are used to support programs benefiting disabled veterans.
4. TAX DEDUCTIBILITY AND IRS COMPLIANCE
4.1 Nonprofit Status
DVEN is a registered 501(c)(3) nonprofit organization. Contributions to DVEN may be tax-deductible to the extent permitted by law.
4.2 Tax Receipt
DVEN will provide you with the documentation required by the IRS for vehicle donation deductions, in accordance with IRS Publication 4303 (“A Donor’s Guide to Vehicle Donations”) and applicable law:
– If your donated vehicle sells for $500 or less, or is used directly by the charity, you may be eligible to deduct the vehicle’s fair market value up to $500, and DVEN will provide a written acknowledgment of your donation.
– If your donated vehicle sells for more than $500, DVEN is required to provide you with IRS Form 1098-C within 30 days of the sale. Your deduction will generally be limited to the gross proceeds of the sale.
4.3 No Tax Advice
DVEN does not provide tax, legal, or financial advice. The tax deductibility of your donation depends on your individual circumstances. You are solely responsible for determining the tax consequences of your donation. We strongly encourage you to consult a qualified tax professional or refer to IRS Publication 4303 and IRS Publication 526 (“Charitable Contributions”) before filing a tax claim related to your vehicle donation.
DVEN makes no guarantee regarding the tax benefit you will receive from your donation.
5. SMS/TEXT MESSAGING POLICY
5.1 Consent to Receive SMS Messages
By providing your mobile phone number through our Website, by phone, or by any other means, and by indicating your consent (including by submitting a form that references this consent), you agree and consent to receive autodialed or prerecorded calls and SMS/text messages from DVEN, its affiliates, and authorized agents at the mobile number you provided. Consent is not a condition of making a donation or receiving any service from DVEN. You may revoke this consent at any time as described below.
You provide consent to receive SMS when you:

5.4 Carrier Fees

All content on this Website, including but not limited to text, graphics, logos, images, and software, is the property of DVEN or its content suppliers and is protected by applicable intellectual property laws. We grant you a limited, non-exclusive license to view and use this content for personal, non-commercial purposes only.

You agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Website shall be resolved in the state or federal courts located in Orange County, California, and you consent to the personal jurisdiction of such courts.
